1) Where applicable the provisions of the Consumers Guarantees Act applies.

 

2) All goods returned for credit must be received within seven days of invoice date.

 

3) Electrical items and procured goods are not returnable.

 

4) All goods returned are subject to a 20% handling charge.

 

5) All goods remain the property of BM Warehouse (2005) Ltd until paid for in full.

 

6) Liability for goods lost or damaged in transit is the responsibility of the purchaser. BM Warehouse (2005) Ltd may, at their discretion, assist the purchaser  with a claim against the Transport Company concerned but will not, under any circumstances, be liable for the replacement of goods lost or damaged in transit.

 

7) Limit of liability on faulty parts extends only to the replacement of the faulty part, or a refund if replacement not available, and does not extend to any other cost that may arise (as per clause 8).

 

8) The purchaser acknowledges and aggress that parts supplied herewith are not manufactured by BM Warehouse (2005) Ltd (the Company) and that the Company disclaims all manufacturers warranties and assigns to the purchaser all of it's rights (if any) arising out of any warranty provided to the Company by the supplier or manufacturer of the parts. The company shall not under any circumstances be liable to the purchaser or any subsequent user for any breakdown or failure, non performance, non suitability or non compatibility or for any consequential or incidental damages arising therefrom, or the costs invested in the replacement or refitting of any faulty part.

 

9) Second hand parts are supplied as being in used condition with no warranty or guarantee. In the event of the part or unit being faulty when first fitted, BM Warehouse (2005) Ltd will replace the part or unit with another second hand part or unit. If this is not possible a refund of the cost of the faulty part or unit will be made. BM Warehouse (2005) Ltd shall not under any circumstances be liable to the purchaser or any subsequent user for breakdown of failure, non performance, non suitability or non compatibility or for any consequential or incidental damages arising therefrom and will not be responsible for or accept any liability for any costs for removing of fitting parts or units.

 

10) Payment Terms. Payment for goods and any freight charges must be made in full prior to the�  goods being dispatched from our Hamilton Warehouse. Payment can be made by Credit Card (American Express not accepted), Direct Credit to our bank account, Cheque or cash. In the case of Direct Credit and Cheques payment will be deemed to have been made once the funds are cleared.. 
  
 Companies and Businesses involved in the Motor Trade may apply for a Trade Account by completing our Credit Application Form. Normal credit criteria apply. 

 

 Where credit facilities have been extended to the purchaser the purchaser agrees to pay in full the invoice balance due on or before the 20th of the month following invoice date. Interest at the rate of 1.75% per month will be added to all overdue balances. All accounts remaining unpaid after 60 days from the due date well be without warning to the purchaser, handed to a Collection Agency for their action. All debt collection and legal fees incurred in recovering overdue accounts will be added to that account.

 

11) The acceptance of the goods by the purchaser shall be deemed to be also an acceptance of the above mentioned terms and Conditions.
